Legal Question in Traffic Law in Virginia
Ticket - following to close
I received a ticket for following to close in Henrico county. I mailed the payment in over 2 weeks ago, check has not cleared. I called the Court Clerk to check on this, and they have no record in their database. What do I do now. I don't know wether I should go ahead and show up at court, I am not on a docket, or wait and see if I am tried in abstenia and pay the fine after. I keep checking with them, but they still have not record, I don't even know where my check ended up.

Re: Ticket - following to close
Check with the court again one day before your hearing date and if they still have no record of your payment, ask the traffic court clerk to put a note on your court file saying that you called and stated that you've already prepaid your fine by check. Then wait to see what happens, whether you're tried in your absence, etc.
If the payment has actually been lost in the mail
(or otherwise permanently detoured from the courthouse), you may have to formally stop
payment on the first check and then reissue it to pay the fine.
