Legal Question in Traffic Law in Virginia

Can I get out of a ticket because of misinformation?

I was involved in an accident where i ran my car into an embankment. I totaled my car and got hurt really bad there were no other cars involved and there was no property damage but my own. I did not notify the police but my car was found hours later (because i had no cell phone and i was out in the middle of nowhere) and then the police showed up when I was already in the hospital. Now I am being charged wtih failure to obey a stop sign. The ticket has my name mispelled and the date of the accident is wrong on the ticket. Will that help me get out of the ticket? If that won't help me, how else could i get the ticket reduced?

You have the right to contest the charge at a trial before the traffic court judge. It would be

wise, if you choose this course, to consult an attorney beforehand who has experience in traffic court and with the Motor Vehicle Code of Virginia. (Note: merely because your name is misspelled on the ticket and the date is wrong

will suffice to get the matter dismissed or enable you to win at trial based on these minor law enforcement lapses alone.)
