Legal Question in Traffic Law in Virginia

Ticket in VA but from NC

I recently received a speeding ticket (80 in a 65) in VA, but am a resident of NC. Am I still elligible for a Prayer of Judgement?

Thanks

No, Virginia does not have prayer for judgment as an option for traffic matters.

I don't believe that Virginia recognizes anything called a "Prayer for Judgment." Nor do I understand why you would want one. Literally it would be asking for a judgment against you.

Actually, I think the correct term is "Prayer for Judgment CONTINUED" (meaning postponed to a future date, at which time the charge is dismissed if you don't get into further trouble.)

If you were ticketed at EXACTLY 80 in a 65, you may barely escape a very serious charge of the CRIME of reckless driving. Make certain that you were not charged with that. If you are going either 80+ or 20 over the speed limit, you can be charged with a misdemeanor... a criminal record. Check very carefully what you have been charged with.

Obtain a copy of your driving record and if it is good go and negotiate with the prosecutor to plead to going 74 or 75, not 80, and pay the fine. The risk of being close to 80 is too high.
