Legal Question in Traffic Law in Virginia
I got a ticket in Virginia for speeding 65/35 after reading the ticket later on I saw this and knew that the speed limit was not 35 where I was it was 50. However the violation he got me with was 46.2-878 which states that law enforcement officials I guess have the right to change the speed limit but there has too be signs and they have to be positioned a certain way and I do not remember seeing any signs at all. Could that help me fight the ticket? Also when he gave me the ticket he pointed out where I can just pay the ticket and not have to go to court so does that mean he might not show up because he thinks im just going to pay the ticket? Also where I was stopped there is a new overpasss and the cars from the street below have to merge with the cars from the overpass, could I use the excuse that I needed to adjust my speed to make sure I could merge safely with the people coming from the overpass?
