Legal Question in Traffic Law in Virginia

VA-Commonwealth Reckless Driving Ticket

Last year on Jan 16,2007 heading North Bound on I 95, in richmond Virginia I was stopped by an undercover cop for reckless driving, he claimed he ''paced'' me doing 95mph in 65mph, I denied all the charges but eventually my lawyer suggested i plea guilty. The officer was with VA state police, he arrested me and searched my car as i had a radar dector and my girlfriend had reached to pull it down, the officer feared at first i had a gun. I was booked released on bond, I later had to plea guilty to the charges received 3month without a license, 11points on my license and had to take a driving class. I had also received a ticket in Fairfax county,va literary an hour before this ticket.

Now a year later I received a ticket for doing 83 in 65mph under section 46.2-862. My court date is next week, what can be my possible can be any other ways I can prevent jail or loosing my license. My money is very limited near nothing, and my girlfriend is unable to work and 8 1/2 month pregnant, what can I do? How can i plea for a lawyer probono, or anything?

Re: VA-Commonwealth Reckless Driving Ticket

Since reckless driving is a jailable offense(class 1 misdemeanor), you could contact the clerk's office of the particular traffic court involved and ask whether you might be eligible for a court-appointed attorney(probably not).

However, even without an attorney, since you were "only" 3 mph

above 80, you should be able to get the reckless charge reduced to a speeding infraction (79mph or less)if you agree to plead guilty to the reduced charge.
