Legal Question in Traffic Law in Virginia
Is it worth it to go to court?
I was just up in Radford, VA this past weekend and received a ticket for ''FAIL TO OBEY HIGHWAY SIGN'' at the intersection of Tyler and Jefferson. I was in the right hand lane and continued to go straight through an intersection when I realized that the lane merged into the other lane so I changed into the left lane and immediately saw blue lights behind me coming from an unmarked car. The undercover officer pulled me over and told me that I ''knew what I did wrong'' and never gave me a chance to explain myself. When he returned with my license, registration, and ticket I explained the situation and he said ''regardless, you cut off another car'' and told me that he could have given me a reckless driving charge but instead gave me the lesser of the two. Honestly, the car behind me was not even close when I merged into the other lane so I do not consider that ''cutting off.'' On the way back I came back the exact same way and noticed that there was not a ''turn lane only'' sign but instead it was just in white paint on the lane and was hard to see due to the heavy rain and poor lighting. I wanted to see if I would have a case in court or whether I should just pay it and take the points that I don't feel I deserved. Thanks!

Of course, contest it in the local general district traffic court.
