Legal Question in Wills and Trusts in Virginia

Three cars...

My uncle died left three cars on my parents property. He did not have a spouse� and he was in considerable debt. Two cars are very old, no longer run and are worth nothing. The third one is worth a few thousand dollars.

All three are titled to him. According to DMV my mother�(my uncle�s sister.) her two brothers have to all sign a form to get the titles so that the cars can be sold and the money given to the creditors and of course have the cars removed from my parents property. But my mothers two brothers are refusing to sign since there is no money in it for them.

Is there anyway to get the titles or declare it abandoned property and have it removed or is there another way?

Your mother could apply to the probate court in the locality where your uncle died to be appointed administrator for his small intestate estate. She then would have all the authority necessary to secure the titles to the vehicles and any other assets which might belong to the estate, sell the assets, pay the creditors and any other bill belonging to the estate, and then distribute to the heirs any assets which might be leftover, if any. (No signatures of other family members would be required in order for this afore-described process to be completed.)
