Legal Question in Wills and Trusts in Virginia

contesting a will after 19 years

My mother died 19 years ago. On her dead bed my brother had her change her will, making him sole heir. She was dying of cancer and was not in a sound state of mind. He and I were the only heirs before the will was changed. After this amount of time can one still contest the will in the state of Virginia?

Re: contesting a will after 19 years

Parties to the will such as yourself would've been required to appeal the probate court's final order within the required time frame. Folks who were not parties to the will would've had

one year from the entry of such order.

Sec. 64.1-89

In either case, some 19 years after the demise of the decedent, is way too late for anything but regrets.
