Legal Question in Wills and Trusts in Virginia

credit

If my father has passed away and he owes debt on this credit card accounts but the credit card accounts are solely under his name would the surviving family members have to pay all his credit debt? If it can not be paid what will happen? Will our estate, house, and cars be taken away?

Re: credit

Liability for your father's debts is limited to his assets; if there is not enough in his estate to pay the debts the creditors have no right to go against the assets of surviving family members, UNLESS there has been a distribution from his estate to family members. In that case, the funds distributed would have to be returned to the estate to be paid to creditors.
