Legal Question in Wills and Trusts in Virginia

After having two debilitating operations, while on rehab, my wife made a will leaving all worldly possessions to our daughter. We have been married 34 years. How does that effect me?

In lieu of taking what is left you under the will of your spouse, you may elect to take a share which is roughly one-third of her "augmented estate", a term that has a complex definition under Virginia statutes. If that should be your desire at the time of her death, you should consult an attorney for assistance in filing for your elective share and calculating the augmented estate.
