Legal Question in Wills and Trusts in Virginia

estate

my sister is administrator of my deceased parents estate. i believe i have lots of reasons to have her removed of her duties an another family member appointed. one is we had wind damage and the roof is leaking.. this has been 3 months since she recieved a check from insurance company yet she has failed to take care of this. by the way it is raining every week here in va. secondly there was leins against the property of unpaid debts in the amount of approx 10 grand. my brother and i live here at the estate property so he and I paid off all of those debts 3 months ago. today we recieve a letter from her attorney saying he has filed a petition in court to ask the judge to give her the permission to sell the property due to unpaid bills. i dont get it. there are no unpaid taxes or bills what so ever. is this attorney just trying to milk her for money or what? also she had the attorney send us a letter saying not to contact her,,, only him so theres more un-necessary reason for her to make all the judgements on something we have to pay. my brother and i want to purchase the home but we need more time. is there something i can file to ask the court to dismiss her of her duties and appoint another qualfied family member ?? thank yoU

Re: estate

You should check with the clerk of the probate court to determine whether the petition alluded to by the attorney has actually been filed and then consult with an attorney who does probate work in the area as to how this petition should best be responded to, and who also may be able to advise you regarding other issues you may have regarding this estate and your status as named beneficaries(presumably you and your brother as well as your sister).
