Legal Question in Wills and Trusts in Virginia

Ethics of estate planning

A church has an estate planning seminar and they ask my father if he would like their help in revising his will. He agrees. They ask how much money he would like to ''give to God'' (their church). He decides to leave something for the church. Under these circumstances, is it ethical for an interested party to draw up a will?

Re: Ethics of estate planning

It is not considered ethical for the entity preparing a will to do so if they are the recipient of a gift. Although many entities "sell" wills and trusts, in Utah only an attorney should prepare wills and trusts. Otherwise it is considered practicing law without a license.
