Legal Question in Wills and Trusts in Virginia

Executors of a Will

Myself and a brother are executors of my Father's will. I have another brother that is only an heir to the will. Everything is to be split between me and my two brothers. We have a house to sell. To put the house on the market to sell, do all three heirs have to sign the Realtor's contract just to put the house on the market or can just the executor's have to sign the contract. My one brother (just the heir is being difficult about selling the house) Also, what are our options to get the other brother to agree to sell the house?

Re: Executors of a Will

No, the executors are empowered to sell the property for the benefit of the estate without the signature of the third sibling either on the listing or the sale contract and to execute an executors' warranty deed conveying the property to the BFP for value in the event of such a sale.
