Can someone be appointed as the executor of an estate after a death by petitioning the court?

Yes, if there's a will naming an executor, and this executor in unable to perform the required duties,

a petition could be filed with the probate court by a proper person to replace this executor.

And, in the event that there was no will(decedent died intestate), the appropriate person could also file a petition with the probate court to be appointed the personal administrator of this decedent's estate.
