Legal Question in Wills and Trusts in Virginia

Family trust

My father died in April, 2009. He had a revocable trust. I have learned that he also has a ''Family Trust'' in his name. Would my father have had to execute the Family Trust or could my mother do it with power of attorney? Why would a Family Trust be better than a Revocable Trust? Thank you.

Re: Family trust

A POA is without legal effect once the principal has become deceased. As to your other questions, you should arrange for a consultation with an attorney with experience and expertise in trusts and probate matters who can have the opportunity to review the various documents and pertinent facts surrounding their making in order to further advise you.
