Legal Question in Wills and Trusts in Virginia
My father and mother jointly owned real and personal property in virginia. my father died 6 years ago. Does his ownership share automatically go to my mother, or does 50% go to her and 50% go to the surviving children?

The first question is whether your father had a will, and if so, what did it say. If he left no will, his estate would go entirely to his wife, your mother; the surviving children would have no interest in his intestate (no will) estate unless his wife was not your mother -- i.e. you were her stepchildren.
