Legal Question in Wills and Trusts in Virginia
what can I do?
My father was recently put in the hospital, because of a fall. Me nor my sisters were notified. Instead we there was a letter sent, from dad's brothers lawyer saying that they wanted to place POA, to make financial decisions and the decision to place him in a nursing home, to a nephew and the brother. This was done behind our backs. My letter was sent to a wrong address and I think that was intentional. As his children, don't we have the right to detest this, and ask for the right to make this decision? They are trying very hard to say that he does not have the mind to appoint anyone. We are his children and he is our father, so shouldn't we be making this kind of decision? I really do NOT trust these people, they have cheated him before and I am scared they are going to throw him in some dump, and take his finances, then what will happen to him? They want money, we just want what is best for our father, can someone please help me with this? I will be contacting a lawyer, but I just want to know what to expect. Thank you in advance.

Re: what can I do?
Yes, the lawyer you consult will likely advise that you file a request with the appropriate probate court to be appointed your father's conservator which will allow you to take charge
of his financial and other affairs.
