Legal Question in Wills and Trusts in Virginia

finding someone's will after their death

My son-in-law's mother passed away suddenly this past weekend. They are looking through her house to find the most current will - but can only find one 25 years old. The family believes that she has an updated will but does not know who her attorney is. They believe that the will will specify how and where to inter her remains as well as what she wants done with her possessions. How can this be located?

Re: finding someone's will after their death

There is no way to find a will other than questioning those that are most familiar with the deceased to determine if she may have told someone. Common places are safe deposit boxes at banks or brokerage firms, maybe questions to her financial advisors or any close friend who may have been a witness on the will. Other than that, a thorough search of the house would be the only suggestion. Are there are any other documents in force such as powers of attorney or Trusts? These may give a clue to at least who the witnesses might be.

That's a pickle if you are searching for a

needle in a haystack. You might try looking

through her checkbook for any checks written

to a lawyer. If she had no other reason to

use a lawyer, that might be really tough. If

it is a small town you could try the lawyers

who do estate work and wills. Also, of course,

check with her bank to see if she had a safety

deposit box.
