Heir Property

A mother died without a will, she had a house which goes to three daughters. One sister has lived in the house and paid the taxes, but now wants to move out because other relatives have moved in causing a hostile enviornment. This sister wants to sale her share of the property to the other sisters. What is the law in Virginia?

Yes, after a proper deed of heirship or affidavit has been recorded in the land records of the appropriate circuit court, the one disaffected sister should be able to sell her share of the property to the other heir siblings.

Nevertheless, it would appear prudent to involve a local attorney to at least review and advise the parties with respect to any actions which they may contemplate in this matter.
