My mother passed away in 2006. Her mother(my grandmother) passed away in 2004. My aunts are selling my grandmothers house. I was told because my mother has passed my father my mothers husband is entitled to my mothers share of the house. Is this true? Or should it go to my mothers children, who are blood related.

Re: heirs

The surviving spouse of your mother would be entitled to one third of her estate, and her biological children two thirds. These children would consequently have a two thirds claim to their deceased mother's share in the home.
