Legal Question in Wills and Trusts in Virginia
My husband & I are married & living in the State of Virginia. Do I need a medical power of attorney for him to make medical decisions regarding my care?

No, most likely not (my opinion), but if you have a serious medical condition you should have a
document in place known as an Advance Medical Directive which explains what procedures you
may wish to have pursued in your behalf (or not) in the event that you become comatose or otherwise
unable to speak for yourself.

It is my view that everyone should at least consider having an Advance Medical Directive, which includes a living will, a medical power of attorney and often instructions regarding organ donation, regardless of whether one has any health problems.
