Legal Question in Wills and Trusts in Virginia

My husband passed away recently. We were still legally married, but separated. He had moved his personal things to his girlfriends house. There are quite a few sentimental items that me and our children would like to obtain. She has given us some items but refuses to release any more. Are there any legal avenues that my children and I can take to get these things?

If you appear in the Probate Office of the Circuit Court in your jurusdiction and get appointed executor (if there is a will) or administrator (if there is not) you will have the authority to require the girl friend to turn over his property to you as part of your responsibilities to see that it gets distributed to his beneficiaries (if a will) or heirs ()if not).
