In 1995 my sixteen year old daughter was driving her boyfriends fathers car,( he was with her in the car ) even though I had told her not to do that. She did not have a drivers license at that time either. She had an accident which resulted in about $1200.00 damages. The damage was paid for by the fathers auto policy. Now, over four years later this man has issued a debt warrent againest my daughter for the cost of repairs to the car. Is there a statue of limitatins on a case like this? Or is my daughter obligated to pay up. She had the sons permission to drive the car, where does the blame lie at this time? Thank you, --name removed--E.

The statute of limitations on property damage torts in Va. is 3 years. There are grounds that can extend the statute, so it is not a sure thing.

The statute of limitations for property damage in Virginia is 5 years. Its probably the owner's insurance company who is behind the suit. The responsibility, I would think, lies with your daughter.
