Legal Question in Wills and Trusts in Virginia
life estate
My father in law has a life estate on a house and property and upon his death it goes to my husband. My father in law is now in a nursing home and according to his doctor, incapable of signing anything relinquishing the life estate. We hate to see the house just sit there. what are our options?

Re: life estate
Some member of your father-in-law's immediate family should petition the appropriate Virginia probate court to be appointed as his conservator
which would empower this person to take whatever steps are necessary to appropriately deal with all of your father-n-law's financial affairs including the disposition of his life estate.
