Legal Question in Wills and Trusts in Virginia
Life Estate Rights
My father has a life estate for the home I and my father are living in. Do the other people who will get the property when he passes away have the legal right to do a home/property inspection, when the property is in excellant condition and well taken care of (no need to evict)? I received a letter from one of the receipents (who is not the executator) stating he had hired a home inspector to do a SAFETY inspection of the property (not including the home, unless I want them to (???)). I feel this person is just trying to start trouble. Is my gut feeling right??

Re: Life Estate Rights
No, I see nothing wrong with permitting the residuary devisees in having an inspection done of property which eventually they will inherit (as long as they pay for it). These folks will not be able to evict your father from his life estate interest in this property merely by means of an inspection report on the property.
