In the case of the death of an 18 year old (no will) the insurance policy beneficiaries state the mother, father and brother. The problem is the bio mother and father are divorced and remarried. The bio father signed away his parental rights and the stepdad adopted the children. Now the bio father has 3 more children. How will the life insurance proceeds be divided and who will decide? Do the proceeds go into the estate? There are no other assets.

The proceeds of life insurance normally pass directly (outside of any estate)to the beneficiaries named in the policy which in this case are probably the bio-mother, the step-father who adopted the decedent, and the bio-brother.
