Legal Question in Wills and Trusts in Virginia

Locate probate of my fathers will

My father, Robert David Wilson, died in May of this year, and his wife, my stepmother, Jean Wilson, is stonewalling me in regards to his will. How can I find out what the will stated?? He was 90/91 when he died and left his wife Jean, one child (me)and three adopted children, Mark, Lisa and Eric Wilson. Any suggestions will be appreciated

Re: Locate probate of my fathers will

Check with the clerk of the probate court of the city or county where your father died to see whether his will has been filed with the probate case which should've been opened by now. A will filed with the court is a public record and open to scrutiny by any person who requests to see it.

If there is no will in the probate court, you can file for an administration of the estate nominating your own administrator. If the estate is worth this effort, you should see an attorney in VA.
