Legal Question in Wills and Trusts in Virginia

can he make me move

My mother recently passed away.Dad deserted her 7 years ago.I have POA AND EXECUTOR of her will.Mom left me the mobile home in which I currently reside. It is in both names( NO AND/OR SURVIVOR IN TITLE).Now he decides to start paying the mortgage.I am still paying the mortgage as well.He is not paying the lot rent. I have been helping mom pay the mortgage, lot rent, utlities since dad left. Can he make me move out ? What is my legal standing in this matter. Is he now responsible for all the bills mom has accumulated (she died of lung cancer and has many outstanding doctor bills). He and mom are not divorced, he just left one day. Mom put in a missing person report and he called after several days saying he's free, white and 21 and can do whatever he wants. He did try to come back and mom had to have a restraining order put in place. is that restraining order still good being that he was never served

Re: can he make me move

Whether or not your father can make you move out depends upon who's the real owner of the property, now that your mother has passed.

It would appear that you would be well advised to arrange for a consulation with a local attorney who can review the pertinent documents along with the relevant facts surrounding this unhappy matter and who should then be able to advise you, accordingly.
