Legal Question in Wills and Trusts in Virginia

No more money left in the Estate

The Executor of an estate pays known bills (funeral, medical) of the decedent over a reasonable period of time (8-months after death), distributes assest/monies as dictated by the Will, and is ready to have the Will deemed fully executed. There are now no other properties/monies that were solely owned by the decedent. Based on the aforementioned, what happens if a medical bill or two shows up, but there are no longer any assets available to the Estate to pay such bills? Are the entities who are owed money out of luck, or does responsibility then flow to spouse/other family members?

Re: No more money left in the Estate

I do not understand what your role is in this matter or why the estate administration was limited to "properties/monies that were solely owned by the decedent."

I advise you to consult immediately with a Virginia probate attorney.

If it's a medical bill incurred while the now deceased one was still among the living, the spouse could be held responsible for it.
