Legal Question in Wills and Trusts in Virginia

My mother recently passed and she drew a line through my son's name and $10,000.00 that she had listed there, wrote void and initialed it on the origional copy of the trust. How can my brother and I see that my mother's wish to not give him this money happens when the bank is executor? He had no contact with my mother for 15 years and has ignored me as well as the rest of the family.

If the bank is executor of your deceased mother's estate, then it has a fiduciary responsibility to faithfully follow the instructions set forth in your deceased mother's trust which apparently effectively disinherits your son from inheriting anything from his grandmother.

However, if the bank should seem to start making noises that it may have other intentions with respect to this matter, then go see a local attorney in your area who handles wills, trusts, and estate matters and who should be able to advise you, accordingly.
