Legal Question in Wills and Trusts in Virginia

Nephew died, has two sons, no will, much debt and very little assets, not sure it is worth the trouble to settle. Do you HAVE to settle and what do you do about a vehicle in the name of the deceased?

There are certain exemptions available to heirs of an estate which take precedence over creditors, so it might make sense to probate the estate just to make claims for the grandnephews.
