Legal Question in Wills and Trusts in Virginia

My parents are divorced, I am not sure for how long. About 20 years ago, they purchased a burial plot with both their names on the deed. My mom passed a couple of days ago, do we need to get her ex's permission before we place mom in the plot? No one in the family has had any contact with him for a while now, and apparently in the divorce proceeding my mom mentioned the plot, and his lawyer said "oh well..." This is a very time sensitive question as we are looking to have the funeral Friday. Please help.

Better get a copy of the deed to the plot from the cemetery and arrange to have a local attorney review it along with a copy of the final decree of divorce.
