Legal Question in Wills and Trusts in Virginia

Does past due child support have a statue of limitions?

Absent father just died. Child support issue ordered in 1963 and 1968, never paid. His will leaves farm to biker gang, nothing to children. Is child support order to old to place lien against will.

In Virginia, the support obligation as it becomes due and unpaid creates a judgment by operation of law, but only when docketed in the city or county where the real estate is located. You need to consult an attorney for the purpose of computing the amount due, with interest, and docketing the judgment in the proper city or county land records.
