Legal Question in Wills and Trusts in Virginia

proceeds from sale of home not being paid out in unison

I have 2 sisters, one of them is the executor of our Mom's estate. The last thing to do was to sell the house.. it sold and was closed on Oct 25, 06. The youngest sister rec'd her third of the proceeds after having to ask for her money. The executor sister will not talk or answer me in writing or orally. I want my share of the proceeds now. What can I do besides hiring an attorney to get my money from the sister/executor?

Re: proceeds from sale of home not being paid out in unison

You could notify the Commissioner of Accounts who is charged with supervising the probate of your mother's estate regarding what you regard as unseemly delay(but which likely is not). If that proves unavailing, then you could file suit against your executor-sister in the appropriate Virginia court.

You should be aware, however, that the executor may still be tying up loose ends, so to speak, by paying off creditors, and handling other estate matters prior to making final distributions.
