Legal Question in Wills and Trusts in Virginia

Refunding Bond and Release

I received distributions from my father's estate over two years ago. At the time I was not asked to sign a refunding bond and release. I just received a request from the executor's attorney to sign the refunding bond and release. I do not want to sign it because of ethic issues with the ececutor. What happens if I do not sign the refunding bond and release?

Re: Refunding Bond and Release

If there are now for whatever reason insufficient assets to pay creditor claims against your father's estate and you refuse to sign the refunding bond/release whereby you would agree to return to the executor your ratable share of whatever distribution you received which may now be necessary to pay these claims, the executor could likely bring suit against you in behalf of the estate for whatever this amount might prove to be plus applicable costs.
