Legal Question in Wills and Trusts in Virginia
Need to sell my daughters house
I lost my Grandparents last May.In thier will they left a house to my daughter. It officially becomes hers later this month. The house is in Virginia and we live in Colorado with no intentions of moving back.We currently have to pay taxes on it and it is a very old house. We have no way of keeping it up and every year that passes the less it will be worth. My question is what steps do we have to take to get this house sold.It is doing nobody any good just setting thier and we are currently in need of some financail help but we are unsure as to how we can get everything clear and legal as far as selling the house. Please advise

Re: Need to sell my daughters house
Check with a local probate attorney in the jurisdiction where the property is located to determine whether it needs to be subject to an ancillary probate to give clear title to the beneficiary named in your grandparents' will(your daughter).
Then, once the issue of the title is clear, you could hire a local realtor to list the property for sale, but given what market conditions are like right now in Virgina, you might want to hold off awhile in selling it until things improve.
