what can i do about step mother refusing to probate fathers will, he passed away in Oct. 2011

She is past the time only she can apply to probate his estate. You can go to the local probate office in the Circuit Court and apply to administer his estate; if you don't have the original of the will you would tell that to the probate office and seek to be named administrator of an estate without a will.
