suing an estate in Virginia

My dad passed away about 5 weeks ago. He had a live in girlfriend who thinks she is entitled to more than what she was left. There was a religious wedding but not a civil one. Everything was left to the 3 children with her having life rights to live in the house. She has had a lawyer write my brother a letter stating that she wants $40,000.00 a year for life to live on and she is willing to take that out the $100,000.00 my father gave her when he was alive. After that is used up she wants his children to provide the $40,000.00 per year to her. Can she sue the estate for that money ..there is a valid will...also can she sue us for that??
