Legal Question in Wills and Trusts in Virginia

Is there a timeline for an executor?

I have a family member that was named executor of a family member's will, she is an heir along with 3 other people. She has taken no action in 2 years to carry out the will, but is using the personal belongings to her advantage and her family's advantage without the consideration of the heirs named in the will. How long before she has to take action on the will and can she wait until all other heirs have become deceased before distributing the proceeds of the will?

Re: Is there a timeline for an executor?

There are very definite timelines in the Commonwealth that the the executor of an estate must adhere to for probating a will. The entire process, including the filing of the executor's final report with the commissioner of accounts is suppose to take place within a period of around 14 months.

It may be that you and the other heirs should consult counsel about filing a motion to have your sister removed as the execuor of this particular estate.
