Legal Question in Wills and Trusts in Virginia

My wife died intestate. The only item in her estate is a deed for an undivided interest in a RV camping resort obtained during our marriage and for which we paid $500. The deed was in her name only. She has five children by a previous marriage. We have no children from our marriage. The question is:

1. Who inherits this membership?

2. By what means is the ownership transferred to the heir(s)? (forms, affidavits, new deed, etc.? )

Her five children would technically be eligible to claim 2/3 ownership of the

membership and you would get 1/3, per Va. Code Sec. 64.1-1.

As for completing whatever paperwork is necessary to reflect this new ownership

status, you might want to contact the resort or the agency handling its membership matters.

However, for a $500 camping site (to be shared among six people), there might be the question as to whether the above would be worth the effort that might be involved.
