Legal Question in Workers Comp in Virginia

can not get any answers....

I recently hurt myself at my job. I was told by the doctor i have something called frozen shoulder. Was placed on restricted duty but really could not do my job. I asked my employer what do i do since i've lost at least a week of pay and still waiting to hear about the dr. recommendation for phy. therapy. No one is saying anything and the number to call H.R. is through the store. What can or what am i suppose to do now?

Re: can not get any answers....

WC does not pay for the first 7 days you lose due to an injury unless you are out 21 days then the WC Insurance Company should pay for those 7 days. If the doctor released you to restricted duty, then you need to talk to your HR Department about those restrictions. If they cannot find you a Light Duty Job, then they should put you on Workers Compensation payments. You should notify the doctor, you cannot do your job and tell him why. To protect yourself you should file a Claim for Benefits with the Virginia Workers Compensation Commission. You must be proactive and continue to call the HR Department.
