Legal Question in Workers Comp in Virginia

I was awarded medical for life in 1990 for a work related back injury which remains to be an issue still today. The ins. co. wants to settle, since I am 64 they figure I will be retiring soon. That will not be happening anytime soon, if ever. How do I decide what is a fair settlement?

Correctly evaluating the value of a Virginia workers' compensation case is matter of experience. Each case is unique so there is no simple formula to use. In your case it will depend upon how often you require covered medical, what kind of medical care you are still receiving and what you are projected to need in the future. The real question is, if you are still in need of medical care, why would you consider settling at all?
