Legal Question in Workers Comp in Virginia
Back Surgery;
I had a Decetomy back in January, and2 herniated disk, the disk are still the same and now the pain down my leg and numbness in my foot is worse, can hardly stand, walk, sit, and drive for long periods of time, I cant even teach my little girls to ride a bike.. My doctor said It sometimes takes up tp 6 months for nerves to heal, theres no improvement and I dont want to get hooked on the pain pills, I've been on WC since Sept, I refuse to have any more surgeries due to almost dying after the first due to the anesteha. The PT sessions aren't helping. How long until someone see's that this isnt working? My doctor asked me what can he do to make me better...lol

Based on my 35 years of practice as a Virginia Workers Compensation Lawyer, I can tell you your problem is not simple. You indicated you have been on Workers Compensation since September 2008. You indicated you had back surgery in January 2009 but it did not help. In fact, you indicate the pain and numbness are worse. If you have a Virginia Workers Compensation Award, then you do have lifetime medical benefits for your injury. Generally, the medical care is dictated by the treating doctor. You should check with the Virginia Workers Compensation Commission to make sure you have an AWARD. You can request that your surgeon refer you to a pain management doctor, a physiatrist. You can request the insurance company to refer you for a second opinion. Since the surgery was already done, they will be reluctant to do this. You can contact us for further advice about your situation but you do have a difficult situation.
