Legal Question in Workers Comp in Virginia

I was injured on the job wich led to being out of work for three months returned to light duty for about 43 days went to doctor had to take off 3 weeks and come back had to go back in for surgery again lost my side busness driver quit not find a replacement could not train had to sell truck n to pay everyday bills can i get compesated for this

Dear Sir:

It depends. If the side business was basically the same type of occupation that you do for your Employer, then you may have a claim that your compensation rate for the time you were out should be based on a combinaton of the two incomes. But if the side business is a totally different occupation, then the Virginia Workers Compensation system does not provide a recovery. For example, if your job where you broke your femur was delivery and your side business was delivery, then you would have an argument the two incomes should be combined. On the other hand if your job was as a carpenter and your side busines was delivery, the two incomes could not be combined.
