Legal Question in Workers Comp in Virginia

compensation denied

The company I work for is based in NC. They sent me to VA to work on a project. I was injuried on the job.

The Doctor saya that I have a torn ligament and that an MRI is needed to determine the size of tear and if surgery is needed. VA workers comp is dening the claim. They will not say why. I requested a hearing, but neither a NC, nor VA attorney will take the case. I am attending the hearing on my own. I am not able to work with this injury and cannot afford the surgery if needed. What can I do to help my case?

Re: compensation denied

Your statement is incorrect, i.e., "neither a

NC nor VA attorney will take the case." You simply haven't located one willing to do so.

Re: compensation denied

NC (NC Industrial Commission) can exercise jurisdicton over your case. I would go to their website, and print off a Form 18, Form 33, and Bulletin. File the forms with the NCIC ASAP, requesting an expedited hearing. At hearing, present your testimony and medical records. Ask the judge to send interrogatories to the doctor to answer key legal questions.

Not enough info to tell if you have a compensable case, but this should get you started. Go to ncworkcomp.com to link with the NCIC website. Good luck!
