Re: Define Arbitration;
Arbitration is when the parties and their attorneys present evidence to an arbitrator . The arbitrator makes a decision and both parties have already agreed to do what the arbitrator decides. It is kind of like a mini trial.In Virginia, this is rarley done with Workers Compensation cases. Usually, the parties may go to mediation to try and settle a claim before a hearing. In mediation, the mediator tries to help both sides come to an agreement on the settlement amount. You can always walk away and not settle and still go to the hearing.
