Legal Question in Workers Comp in Virginia
Disease
How would receive an award for degenerative joint disease? Va. law states that diseases are covered if they are caused during course of employment and are not the neck, back and something else..

Re: Disease
You are partially correct that some diseases are covered. However, degenerative joint disease is not covered because it is probably due to repetitive action at work. Virginia WC Law requires that a specific injury be shown. Virginia WC Law does not compensate repetitive injuries of this type. Virginia WC Law will also not compensate it as a compensable disease.
