Re: Doctor Restrictions

Virginia Workers Compensation has very stringent rules about changing doctors. First, you can ask your current doctor to refer you to someone else. Second, you can ask the insurance company to refer you to someone else. Third, you can file a claim with the Commission requesting a change of doctors. This last method is very difficult since it requires proof that your current doctor is providing inadequate medical care. If you switch on your own, the insurance company will claim it is unauthorized medical care and refuse to pay for it. When you are first injured, you have the right to request a panel of three (3) doctors to choose a doctor. However, if you do not exercise this right within 30 days of the date of injury, it is generally considered lost.
