Legal Question in Workers Comp in Virginia

Hand Injury

My brother In-Law severed a nerve in his right hand (dominant) while performing a procedure on his job (air conditioning & heating installation and/or matainance). He received emergency care and was referred to a hand specialist, (surgeon) for further evaluation and follow-up. The hand specialist presented two options after several test and examinations.

Options #1: Have corrective surgery, which would involve reattachment of the nerve, 3 weeks recovery time and a greater chance to increase the percentage of normal hand function or

Option #2: elect not to have the surgery, contend with the possibilities of continued pain and possible permanent lost of some right hand function.

Although my brother In-law is concerned about his hand, he is equally concerned with about managing his debts and month financial obligations during his surgery recovery time. The worker�s compensation representative at his job stated he would have to be off work 3 weeks before he would see and money. They stopped paying him the hour after he was injured on the job.

How does workers' comp operate in Virginia?

What are his rights in this situation?

Can workers' comp payments be withheld for 3 weeks despite the submission of all medical ce

If that's what the Virginia Workman's Compensation representative stated with respect to the time frame for the payment of your brother-in-law's initial qualifying benefits, it is quite likely correct.
