Legal Question in Workers Comp in Virginia

I hurt my foot in oct. of 2010 the nurse only took me to the bone and joint dr.once and I have told her over and over that my foot is still swollen,and this is causing me problems with my knee. I tripped over a chair in the breakroom. They tell me I can't go to my own dr. I told the nurse and dr that my foot feels like it is seprated and snapping back together. He said my foot wasn't broken but I can feel it snapping back in place. what should I do.she was suppose to make me another appoiment in Dec and still haven't made it.do I have a case?

I am a Richmond, Virginia workers compensation lawyer. I assume your case is being covered by a workers compensation insurer. If he did X rays, then this is why he is saying your leg is not broken. If you disagree, you are free to get a second opinion from your own doctor. However, if the insurer believes your current medical care is adequate, then it is not going to pay for a second opinion. If your doctor comes up with the problem, then you can file with the Virginia Workers Compensation Commission to have your medical care switched to your own doctor. You have two (2) years from the date of your accident to file a claim with the Commission for your accident.
